Divorce Lawyers
In Australia, the irretrievable breakdown of a marriage, as evidenced by one year’s separation, is the only ground for divorce. Once your divorce is granted, you have 12 months to commence litigation for a property and financial settlement.
The legal process of divorce is usually the simplest step for most couples. Organising and agreeing upon parenting arrangements, belongings, and financial entitlements are usually the steps that bring about the need for litigation or alternative dispute resolution methods.

Child Custody

Parenting plans may be formalised by a parent, by making an Application for Consent Orders. There does not need to be a dispute between the parents to do this, however, if granted, it does mean the plan would become readily enforceable.

If married or de facto couples own property either jointly, or separately, in the event of a divorce or separation either party is able to request a property settlement. Spousal maintenance or support is payable by one party to another after divorce or legal separation. This is usually the case where one party cannot support themselves adequately, and the other party has the means to provide monetary support.
These days, spousal maintenance orders are set for a limited amount of time. This provides the recipient incentive to upskill or change their circumstances to be able to support themselves.
The legal costs of seeking spousal maintenance may be quite high, which is why it’s recommended to seek this as part of a financial settlement. As each case is so different, we will work with the facts of the case to achieve an optimal outcome.
Litigation, Mediation & Alternative Dispute Resolution
