Child Custody

A complex element of divorce settlements, child custody battles are emotional and difficult for both parties. Our divorce lawyers are passionate about working with you to seek child custody agreements (child welfare orders) that are in the best interests of the children involved. 

If the separation is amicable, both parties may agree to a parenting plan. This is not legally binding and relies on both parties’ cooperation. Our family lawyers can provide you with advice on your parenting plan, and assist you to bring proceedings to court quickly, if necessary. 

Parenting plans may be formalised by a parent, by making an Application for Consent Orders. There does not need to be a dispute between the parents to do this, however, if granted, it does mean the plan would become readily enforceable.

Property Settlement

If married or de facto couples own property either jointly, or separately, in the event of a divorce or separation either party is able to request a property settlement. Spousal Maintenance

Spousal maintenance or support is payable by one party to another after divorce or legal separation. This is usually the case where one party cannot support themselves adequately, and the other party has the means to provide monetary support. 

These days, spousal maintenance orders are set for a limited amount of time. This provides the recipient incentive to upskill or change their circumstances to be able to support themselves.

The legal costs of seeking spousal maintenance may be quite high, which is why it’s recommended to seek this as part of a financial settlement. As each case is so different, we will work with the facts of the case to achieve an optimal outcome.
